Terms and Conditions

Welcome to Band Tour Travel. These Terms & Conditions (“Terms”) govern all travel planning, booking, and advisory services provided by Band Tour Travel (“we,” “us,” or “Agency”). By submitting payment, authorizing payment, electronically accepting these Terms, or requesting that we arrange travel on your behalf, you agree to be bound by them.

1. Our Role as Travel Advisor

Band Tour Travel acts solely as an independent travel advisor. We arrange travel services provided by third-party suppliers (“Suppliers”), including airlines, hotels, cruise lines, tour operators, transportation companies, and other vendors.

We do not own, operate, or control any Supplier. All travel services are provided directly by Suppliers, who are responsible for their own operations, policies, and performance.

2. Definitions

  • Booking – A reservation secured on your behalf with a Supplier.

  • Trip – The complete set of travel services arranged for you.

  • Travel Services – Transportation, lodging, tours, rentals, entertainment, and related services provided by Suppliers.

  • Itinerary / Trip Proposal – The written summary of travel plans and pricing provided to you.

3. Your Responsibilities

You agree to:

  • Review all itineraries, confirmations, and documents carefully.

  • Verify that all traveler names exactly match government-issued identification.

  • Approve travel plans in writing before deposits are processed.

  • Make all payments by stated deadlines.

  • Ensure all travelers meet age and eligibility requirements.

  • Review government travel advisories and entry requirements.

  • Comply with all Supplier policies and rules.

You confirm you are at least 18 years old and authorized to act on behalf of all travelers included in your booking.

4. Supplier Terms & Conditions

Each Supplier operates under its own terms, policies, and cancellation rules. By authorizing us to book Travel Services, you agree to be bound by those Supplier terms.

Supplier policies may include:

  • Non-refundable deposits

  • Strict cancellation penalties

  • Change fees

  • Name-change restrictions

  • Mandatory liability waivers

We are not responsible for a Supplier’s acts, errors, omissions, insolvency, delays, schedule changes, or operational decisions.

5. Pricing & Availability

All pricing is based on the specific services listed in your itinerary. Prices do not include items not expressly listed, such as:

  • Government taxes and fees

  • Airline seat assignments and baggage fees

  • Resort or destination fees

  • Gratuities

  • Personal expenses

  • Travel insurance

  • Currency exchange or foreign transaction fees

Supplier pricing is dynamic and subject to change until payment is received. Even after payment, certain government-imposed or fuel-related surcharges may increase and remain your responsibility.

We reserve the right to correct pricing errors.

6. Payments

Deposits and final payments must be made by stated deadlines. Failure to pay on time may result in:

  • Cancellation of your booking

  • Forfeiture of deposits

  • Rebooking at higher rates

Unless otherwise stated in writing, we are not the merchant of record for Supplier payments and do not control Supplier refund decisions.

7. Credit Card Authorization

By providing payment information, you confirm:

  • You are authorized to use the payment method.

  • You approve charges according to the agreed schedule.

  • You authorize corrections of processing errors.

You are responsible for fees resulting from declined transactions, insufficient funds, expired cards, or incorrect payment information.

8. Chargebacks

You agree not to initiate a chargeback or payment dispute for valid travel charges except in cases of confirmed fraud.

Before initiating any dispute, you agree to contact us in writing to allow reasonable investigation.

If a chargeback is improperly initiated, you agree to reimburse us for related administrative and legal costs.

9. Changes, Cancellations & Refunds

All changes and cancellations are subject to Supplier policies. Many travel services are non-refundable.

Failure to travel (“no show”) may result in forfeiture of the full booking value.

Agency planning or service fees may be non-refundable.

10. Travel Insurance

Travel involves inherent risks including illness, delays, cancellations, and Supplier insolvency.

We strongly recommend purchasing comprehensive travel insurance.

If you decline travel insurance, you assume all financial risk associated with your Trip.

Insurance coverage is governed solely by the terms of the policy issued by the insurer.

11. Travel Risks & Assumption of Risk

You acknowledge that travel may involve risks, including but not limited to:

  • Accidents or injury

  • Illness or medical emergencies

  • Weather disruptions

  • Political instability

  • Transportation delays

  • Supplier bankruptcy

You voluntarily assume these risks.

12. Documentation & Entry Requirements

You are responsible for obtaining:

  • Valid passports

  • Required visas

  • Vaccination or health documentation

  • Any other entry or transit documentation

No refund will be provided for failure to secure proper documentation.

13. Health, Medical & Special Needs

You are responsible for assessing your ability to travel. If accommodations are needed, you must notify us in advance. While we will request accommodations, we cannot guarantee Supplier compliance.

You are responsible for medical costs incurred during travel.

14. Airline Travel

Airfare may be non-refundable and non-transferable.

Airlines may change schedules, aircraft, seat assignments, or routes at any time. We are not responsible for airline operational decisions.

15. Baggage & Personal Property

You are responsible for your baggage, travel documents, and personal property at all times.

16. Traveler Conduct

Suppliers may refuse service to travelers whose behavior is unsafe, disruptive, or unlawful.

If removed from any travel service:

  • You are responsible for all resulting costs.

  • No refund will be provided.

17. Optional & Risk Activities

Participation in excursions, tours, or adventure activities is voluntary and at your own risk.

18. Limitation of Liability

Band Tour Travel acts solely as an intermediary between you and Suppliers.

To the fullest extent permitted by law:

  • We are not liable for acts or omissions of Suppliers.

  • We are not liable for injury, loss, delay, inconvenience, or damages arising from travel.

  • We are not liable for indirect, incidental, or consequential damages.

If liability is imposed despite these limitations, our maximum liability shall not exceed the commissions earned on your booking.

19. Indemnification

You agree to indemnify and hold harmless Band Tour Travel from claims arising from:

  • Your breach of these Terms

  • Your conduct during travel

  • Your violation of Supplier policies

20. Force Majeure

We are not responsible for delays, cancellations, or losses caused by events beyond our control, including:

  • Natural disasters

  • Severe weather

  • Government actions

  • War or civil unrest

  • Public health emergencies

  • Supplier bankruptcy

21. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Tennessee.

Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be brought exclusively in state or federal courts located in Davidson County, Tennessee.

Class actions are not permitted.

22. Seller of Travel Disclosures

Band Tour Travel operates as an independent agency under Legato.

Registration does not constitute state endorsement.

23. Entire Agreement

These Terms, together with your itinerary and applicable Supplier terms, constitute the entire agreement between you and Band Tour Travel.
